Registration Program

Our “turn-key” investment adviser registration program for the State of New York includes:

  • Setting up your firm’s account on the Investment Adviser Registration Depository (IARD) system
  • Acting as liaison with the New York Investor Protection Bureau

Important Additional Information for New York Registrants:

Financial Statements

The balance sheet and income statement filed by an investment adviser registrant must be as of end of fiscal year and, if not within 90 days of filing, registrant’s must also submit an interim statement which is dated within the last 90 days. Investment adviser registrant’s must affix the following language to each statement: “I do hereby certify that this is a true and complete financial statement” followed by an authorized signature (or attach a CPA’s Audit report).

Registration of Investment Adviser Representatives

New York does not register the investment adviser representatives of state-registered advisers. There are, however, requirements for those individuals who represent state-registered investment advisers.  Every individual who represents a state-registered adviser and who does not qualify for a waiver (see below), must take and receive a passing grade within two years prior to the date of filing an application for state-registration on (i) the Series 65 or (ii) the Series 7 and the Series 66.

New York permits the following waivers from the above licensing requirement:

  1. An investment adviser who is an individual or a business engaged in advising members of the public that has been continuously registered in New York for a period of five (5) years without any regulatory action or arbitrations.
  1. An individual who represents an investment adviser in doing any of the acts which make that person an investment adviser or solicits business for an investment adviser, and who has been continuously registered in any jurisdiction, other than New York, for a period of two (2) years prior to the date of filing registration information without any regulatory action or arbitrations.
  1. Any individual who currently holds one of the following professional designations in good standing:
  • Certified Financial Planner(CFP) awarded by the Certified Financial Planner Board of Standards, Inc.;
  • Chartered Financial Consultant (ChFC) awarded by the American College, Bryn Mawr, Pennsylvania;
  • Personal Financial Specialist (PFS) awarded by the American Institute of Certified Public Accountants;
  • Chartered Financial Analyst (CFA) awarded by the Association for Investment Management Research; or
  • Chartered Investment Counselor (CIC) awarded by the Investment Counsel Association of America, Inc.
